We investigate the circumstances behind each listing on your credit file, identifying potential breaches of the Privacy Act or non-compliance with the Credit Reporting Code. This is completed with you over the phone through 40+ simple yes, no, or unsure questions, along with your personal circumstances at the time.

Formal removal requests are lodged with Equifax, Experian, and relevant credit providers, with escalation to AFCA, the OAIC, courts, or other bodies where required.

The honest landscape

Many mainstream lenders decline applications that show unpaid defaults, particularly recent ones. That is the uncomfortable part, and it is better to know it before you apply than after.

Some specialist lenders may still consider applicants with defaults on their credit file. These loans — often marketed as “bad credit loans” or “loans for defaulters” — come at a price:

Two things follow from that list. Recent behaviour counts, because repayment history covers two years and refreshes constantly. And every entry has to be lawfully listed to be there at all — which is where challenge comes in.

What improves your position

Paid beats unpaid

Paying a default does not remove it — the listing stays for its full five years — but the status changes from unpaid to paid, and some lenders view a paid default more favourably than an unpaid one. Paying also ends collection activity and removes the risk of the debt turning into a court judgement, which would be a second, heavier listing.

Challenge wrongly listed defaults before you apply

This is the step people miss, and the order of operations matters. A default can only stay on your file if it was listed lawfully: the debt must have been at least $150, more than 60 days overdue, and the required written notices must have been sent to your last known address before listing. Listings fail these tests more often than people expect — notices to old addresses, wrong amounts, debts listed twice by a creditor and again by a collector.

A wrongly listed default that comes off before you apply changes what every lender sees from that day forward. A challenge lodged after a decline helps you with the next application, not the one you just lost. Disputes with creditors and credit reporting bodies generally run on 30-day response windows; complex matters take longer — another reason to deal with the file before you need the loan, not during the application.

To be plain about the limits: no one can guarantee the removal of a correctly listed default. Only listings that are inaccurate, unfair, out of date or made in breach of the credit reporting rules can be challenged, and where grounds exist we pursue removal until the matter is resolved. Can I get a loan with an unpaid default in Australia?

Some specialist lenders may consider applicants with unpaid defaults, generally at higher rates and with stricter conditions. Many mainstream lenders decline such applications. No one can promise an approval — treat any promise of one as a warning sign.

Should I pay my default before applying?

Check the listing first. Paying updates the status to paid — it does not remove the entry — so if the default was wrongly listed, investigating it before paying may matter more than the payment itself. If the listing is correct, a paid status can read better to some lenders than an unpaid one.

Do failed loan applications damage my credit file?

Each application generally records an enquiry regardless of the outcome, and enquiries remain for five years. Several enquiries in a short window can suggest financial stress to lenders, so it pays to apply selectively rather than broadly.
